Apparently he has (or had) kernel level exploits previously, but that this release will intentionally be user mode to prevent piracy. He doesn't want any of his work to lead to piracy on the system.
Strange mode to think, i suppose. User mode instead, permit the use of emulators and so downloaded roms (Piracy). Kernel mode is required to fan game translations and other interesting stuffs. :?

Piracy of old systems that are not supported on the 3DS is not the same as piracy of current DS and 3DS games.

This. It is a shame that the N3DS release means this is getting postponed... but if it could mean full access to the N3DS mode and all of it's added CPU/RAM, it's probably worth it.
